CCSU Lockdown – Student charged with Breach of Peace
My only comment on the three-plus hour event today at Central Connecticut State University will be referencing the law the student has been charged with.
Here is the text from Connecticut General Statutes 53a-181, Breach of the Peace in the second degree, a Class B misdemeanor.
(a) A person is guilty of breach of the peace in the second degree when, with intent to cause inconvenience, annoyance or alarm, or recklessly creating a risk thereof, such person:
(1) Engages in fighting or in violent, tumultuous or threatening behavior in a public place; or
(2) assaults or strikes another; or
(3) threatens to commit any crime against another person or such other person’s property; or
(4) publicly exhibits, distributes, posts up or advertises any offensive, indecent or abusive matter concerning any person; or
(5) in a public place, uses abusive or obscene language or makes an obscene gesture; or
(6) creates a public and hazardous or physically offensive condition by any act which such person is not licensed or privileged to do.For purposes of this section, “public place” means any area that is used or held out for use by the public whether owned or operated by public or private interests.
(b) Breach of the peace in the second degree is a class B misdemeanor.
So what say you RVO readers? Exactly which definition of CGS 53a-181 did the CCSU student meet to be charged with breach? I’m pretty certain options 1 through 6 are out, so how did he create “a public and hazardous or physically offensive condition by any act which such person is not licensed or privileged to do?“

Another phoney rap to justify their stupidity. He may beat it because of all the publicity. But normally he’d go down because the cops are NEVER wrong.
It’s the Sandy Hook Syndrome. A good lawyer will get him off. He will sue the University in a couple of months for PSTD, profiling and violation of his rights.? He will win a huge settlement.
I am glad that he was not a dangerous nut bent on causing harm.

The democrats in the legislature will introduce legislation banning the wearing of Halloween Costumes after October 31. There will be a fee to register the wearer and a permit issued for the time period when the costume will be worn. Details will be worked out later. Violation will be a felony.

Reactions by ‘authorities’ are the most interesting and instructive in these incidents…. and we used to laugh at Chicken Little!? College students in the 50s and 60s would never have even notified those administrations of a sword carrying student (who might have been in theatre costume).
Why is common sense so uncommon?? When a Halloween costume causes chaos, what would a real event do?? The hysteria and over reaching? by all enforcement agencies after the Boston marathon bombing seem to be the model to be followed.? Those who wish to disrupt our way of life can not but take notice.
While I won’t fault the reaction, because as much as this is nonsense there would be equal nonsense afterwards if something had occurred and they didn’t take these actions. Unfortunately they are in a catch 22 situation criticized for over reaction or criticized for not reacting enough. I want to fault those that called for assuming things, there is too much of that today.
But now the student is going to be charged with Breach of Peace? He didn’t intend to cause any alarm, it wasn’t intentional. Had this been last week on Halloween does that mean none of the students would have called?

If this was his Halloween costume he went partying in, why wasn’t he reported walking around campus when he left?? Was he fully dressed or did he wait to get dressed when he arrived at UConn.? He lives in Newington I believe it was reported.? Could he have not stopped at home to change before going to his dorm?? He did not have to put on the knee pads and mask and wear the sword the way he did.? He could have carried them, attached them to the outside of the backpack or left them in his vehicle.? With all the different instances with people walking around with weapons the law enforcement response was predictable, but?could have been handled better.? Find out what you have first, then bring in the troops if needed.? NB, Newington and campus police did a good job of surrounding and closing off the campus.?
@TheHole – Let’s get the facts straight at least. Being stupid is not illegal as far as I know. His judgement was bad. I don’t think there was “intent.” As for “why didn’t he stop at home” and “left them in his vehicle” that information is widely known. A friend dropped him off in New Britain and he took a bus to campus and was trying to dump the stuff off in his room before he was late for a class or business meeting.
