Half of Obama supporters think SCOTUS rulings should not follow Constitution

This is a brutal assessment on how liberals think the Judicial Branch should make decisions. For conservatives, this is beyond the tipping point and concerns me more than any political or economic subject. Almost half of Obama supporters think that judges should base decisions on what they think is right or fair.

That’s right, almost half of those who will be voting for Obama in November think it is perfectly fine for judges to make rulings without concern to the Constitution and current law.

Rasmussen Reports has the wrap-up on a telephone survey that they completed recently. Unfortunately, I do not have access to the detailed specs of the survey.

The high point – if you can call it that – is that 60 percent of those called agreed that the Supreme Court should base their rulings on the Constitution. Only 60 percent.

Here are the low points.

  • 30 percent say rulings should be guided on the judge’s sense of fairness and justice
  • Only 29 percent of Obama supporters believe the justices should rule on what is in the Constitution
  • 49 percent of Obama supporters say rulings should be guided on the judge’s sense of fairness and justice

McCain supporters are on the right side here.

  • 82 percent of McCain supporters believe the justices should rule on what is in the Constitution
  • 11 percent of McCain supporters say rulings should be guided on the judge’s sense of fairness and justice

Have we missed a civics class or two? Do they even bother to cover the three branches of government anymore?

During his acceptance speech last night at the Republican National Convention in Minnesota, John McCain told the audience, “We believe in a strong defense, work, faith, service, a culture of life, personal responsibility, the rule of law, and judges who dispense justice impartially and don’t legislate from the bench.”

Hot Air reminds us that this is one reason that you must vote for McCain, who has promised to nominate judges who will not legislate from the bench.

Better yet, file this away for the next time some conservative asks you why he should turn out to vote for a guy who supports amnesty.

Exactly why I’m voting McCain/Palin. Granted it’s not the only reason, but for those of you who have completely given up,  can assure you that if Obama gets into office for the next four to eight years, the Supreme Court will easily tip way left.

All this said, McCain is not a guaranty that we’ll get strict constitutionalists judges. I wrote in February that McCain was not too thrilled with the Alito pick because he was too conservative. Google it.

Quite honestly, there are liberal SCOTUS judges that will immediately resign if a liberal gets into office. If more select the R lever in November they will stay in chambers – on life-support if necessary – until death.
